These Website Terms & Conditions (Terms) govern your access to and use of the qore8 (or qore8health) website, any related online store, customer account, content, features, tools, subscriptions and products made available by Touch Biotechnology Pty Ltd (ABN 88 642 988 564) trading as qore8 ("qore8", "we", "us" or "our"). 

By accessing our website, creating an account, purchasing a product or using any of our services, you agree to be bound by these Terms. 

If you do not agree to these Terms, you must not use the website or purchase products from us. 

Important consumer notices 

To help qore8 comply with New South Wales disclosure obligations, we draw your attention to the following important matters before purchase: 

  • our website terms contain limitations of liability that operate only to the maximum extent permitted by law and do not exclude your non-excludable rights under the Australian Consumer Law; 

  • our Privacy Policy explains that we share information with service providers such as ecommerce, payment, delivery, analytics and marketing providers; 

  • subscriptions renew automatically until cancelled, and cut-off times for pause, skip and cancellation apply to prevent the next order from being processed; 

  • international orders may be subject to destination-country customs duties, taxes, import restrictions and delays. 

1. Eligibility and permitted use 

You must be at least 18 years old to purchase products or subscribe to recurring deliveries from qore8. 

You may use this website only for lawful purposes and in accordance with these Terms. 

Our products are supplied for personal use unless we expressly agree otherwise in writing. You must not resell products or samples without our prior written consent. 

2. Product information and health disclaimers 

We aim to ensure product descriptions, images, ingredients information, pricing and availability are accurate, but errors, omissions and delays in updates can occur. 

Website content is provided for general informational purposes only and is not medical advice, diagnosis or treatment. 

Always read the label and follow the directions for use where applicable. If symptoms persist, worsen or you are concerned, talk to your health professional. 

You should seek independent professional advice before relying on website content, particularly if you are pregnant, breastfeeding, immunocompromised, taking medication, managing a medical condition, or purchasing for someone else. 

 

3. Orders, pricing and availability 

All prices are shown in Australian dollars unless stated otherwise and include GST where applicable. 

We may change prices, product ranges, promotional offers and website content at any time before an order is accepted. 

We reserve the right to refuse, limit or cancel any order where we reasonably suspect fraud, unauthorised resale, pricing error, stock unavailability, regulatory concern or misuse of our website. 

Your order is not accepted until payment is authorised and we confirm dispatch or otherwise process the order. 

4. Shipping and delivery 

Shipping, delivery estimates, international restrictions, pre-orders and parcel issues are governed by our Shipping Policy. 

Delivery timeframes are estimates only unless we expressly state otherwise. 

Nothing in these Terms excludes any rights you may have where products are lost, damaged, unsafe, faulty, not supplied within a reasonable time, or otherwise fail to comply with the ACL. 

5. Refunds, returns and consumer guarantees

Your rights under the Australian Consumer Law cannot be excluded or limited by these Terms, any store policy, or any website statement. 

Any voluntary warranty, satisfaction guarantee or return setting offered by qore8 is in addition to, and does not replace, your ACL rights. 

6. Subscriptions 

If you purchase a product on a subscription basis, our Subscription Policy (Link)also applies. 

By purchasing a subscription, you agree to recurring charges at the frequency and price disclosed at checkout until you cancel in accordance with the Subscription Policy. 

7. Accounts and account security 

You may be required to create an account to access certain features. 

You must provide current, complete and accurate account information and keep it updated. 

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account unless caused by our fault. 

You must notify us promptly if you suspect unauthorised access to your account. 

8. User-generated content 

Our website may allow reviews, ratings, testimonials, comments, messages or other content submitted by you (User Content). 

You are responsible for the User Content you submit. 

You must not submit content that is unlawful, misleading, defamatory, abusive, harassing, discriminatory, infringing, malware-infected, privacy-invasive, or that contains another person's personal information without authority. 

Do not include sensitive health information, government identifiers, or payment information in public reviews or similar features. 

By submitting User Content, you grant qore8 a non-exclusive, royalty-free, worldwide, transferable licence to use, reproduce, publish, display, adapt and communicate that User Content for operating, improving and promoting our business and services, subject to applicable law. 

You represent that you have the rights and permissions required for the User Content you provide. 

We may monitor, remove, refuse or moderate User Content at our discretion, but we are not obliged to do so. 

9. Intellectual property 

All website content, branding, logos, copy, graphics, photographs, videos, downloadable materials, software and other materials on the website are owned by, licensed to, or controlled by qore8 and are protected by Australian and international intellectual property laws. 

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the website for your personal, non-commercial use only. 

You must not reproduce, republish, adapt, reverse engineer, exploit or distribute website content except as permitted by law or with our prior written consent. 

10. Prohibited conduct 

You must not, directly or indirectly: 

  • use the website for unlawful, fraudulent or misleading purposes; 

  • impersonate another person or misrepresent your affiliation with any person or entity; 

  • scrape, spider, crawl, harvest or systematically extract data from the website; 

  • use robots, scripts, automated tools or other non-human means to access or interact with the website except through ordinary search-engine indexing or as expressly authorised by us; 

  • use any website content, data or materials to train, fine-tune, evaluate or improve any artificial intelligence, machine learning or generative model without our prior written consent; 

  • upload malware, harmful code or unlawful content; 

  • attempt to bypass website security, access controls or technical restrictions; 

  • interfere with the operation, integrity or security of the website; 

  • copy or exploit our pricing, product data, reviews, imagery or content for competing commercial purposes; 

  • use our products or samples for resale without our consent. 

11. Third-party links, tools and platforms 

Our website may contain links to third-party websites, tools, payment services, review platforms or social media services. 

We do not control third-party services and are not responsible for their content, availability or privacy practices. 

Your use of third-party services is governed by the terms and policies of those third parties. 

12. Privacy

By using the website, you acknowledge that personal information may be processed as described in our Privacy Policy. 

 

13. Website availability 

We do not guarantee that the website will be uninterrupted, error-free, secure or free from harmful components. 

We may modify, suspend, withdraw or restrict access to any part of the website at any time for operational, security, legal or commercial reasons. 

14. Liability and consumer-law carve-out 

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory guarantee or other right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law. 

To the maximum extent permitted by law, and subject to the previous paragraph, qore8 excludes liability for indirect, incidental, special or consequential loss, loss of profits, loss of data and loss of opportunity arising from your use of the website or products. 

Where the law permits us to limit our liability for a breach of a non-excludable guarantee, our liability is limited, at our option, to resupply, repair, replacement or the cost of resupply, repair or replacement, as applicable. 

15. Indemnity 

To the maximum extent permitted by law, you indemnify qore8 and its officers, employees and agents against reasonably foreseeable claims, liabilities, losses, damages and costs arising out of your unlawful use of the website, your breach of these Terms, or your infringement of another person's rights. 

16. Suspension and termination 

We may suspend, restrict or terminate your access to the website or cancel orders where we reasonably believe you have breached these Terms, engaged in fraud, misused the website or created legal or security risk for qore8 or others. 

17. Changes to these Terms 

We may update these Terms from time to time. The latest version will be posted on our website with an updated 'Last updated' date. 

By continuing to use the website after updated Terms are published, you agree to the updated Terms to the extent permitted by law. 

18. Governing law and jurisdiction 

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia. 

You submit to the non-exclusive jurisdiction of the courts of New South Wales and courts competent to hear appeals from those courts. 

19. Therapeutic Goods and Health Disclaimers 

qore8 products may be complementary medicines listed on the Australian Register of Therapeutic Goods (ARTG).
